TERMS AND CONDITIONS

GENERAL

These terms and conditions form the basis of all agreements between Sam Outdoor Living ("we," "our," or "us") and our customers ("you").

By engaging our services, you agree to be bound by these terms and conditions.

We reserve the right to amend these terms at any time without prior notice. Any changes will be posted on our website and will apply to future transactions.

QUOTATIONS

All quotations are valid for 30 days unless otherwise specified.

Quotations are based on the information provided at the time of inquiry. Any changes to the project scope, materials, or requirements may result in an updated quotation.

Acceptance of a quotation must be provided in writing or via email.

Pricing is subject to availability of materials at the time of order confirmation.

DOCUMENT PROTECTION

All documents, designs, invoices, photographs, and other materials provided by Sam Outdoor Living are the property of Sam Outdoor Living and are intended for the customer’s personal use only.

These materials are strictly confidential and must not be shared, copied, or disclosed to any third party without our prior written consent.

Any unauthorized use, duplication, or distribution of these materials may result in legal action.

PERMITS

Customers have the option to request assistance with permits, including planning and building permits, at an additional cost.

Permits will only be processed upon receipt of:

- A 20% deposit on the total project cost.
- Full payment of the permit package fee.

If a customer chooses not to engage Sam Outdoor Living for permit services, the customer assumes full responsibility for obtaining all necessary permits.

Sam Outdoor Living will not be liable for any fines, penalties, or delays resulting from a lack of required permits if the customer has opted out of this service.

Permit-related services include the preparation and submission of planning and building applications, but approval is subject to local council regulations and processes. Sam Outdoor Living cannot guarantee permit approvals.

PAYMENT

A deposit of 20% is required to confirm your order or booking.

Payment is to be made in accordance with the payment schedule provided.

Final payment is due upon completion of the project, unless otherwise agreed upon in writing.

Payment methods accepted include bank transfers, credit cards, or other methods as specified.

Late payments may incur additional fees or interest at 2% per month.

GST

All prices quoted are inclusive/exclusive of GST (as applicable).

GST is calculated at the current rate as per Australian Taxation Office regulations.

CANCELLATIONS

Cancellations must be made in writing and may be subject to a cancellation fee.

Deposits are non-refundable unless agreed otherwise in writing.

If materials have already been ordered or work has commenced, additional charges may apply.

We reserve the right to cancel an order due to unforeseen circumstances, such as supply chain issues or permit denials. In such cases, any payments made will be refunded in full.

INSTALLATION

Installation dates are subject to weather conditions and material availability.

You must ensure the site is ready and accessible for installation on the agreed date. Additional charges may apply for delays caused by site inaccessibility.

All installations are carried out according to local building codes and safety standards.

Any permits required for the project are the responsibility of the customer unless specified otherwise in the agreement.

Warranty

At Sam Outdoor Living, we are committed to providing quality products and services. Our warranties include:

Structural Warranty for Flatdek, Insulated Verandah/Patio/Pergola: 25 years from the date of installation.

Structural Warranty for Colorbond Roof: 12 years from the date of installation.

Paintwork Warranty: 5 years from the date of installation, covering peeling, blistering, or significant discoloration under normal conditions.

Workmanship Warranty: 3 years from the date of installation, covering defects in assembly or installation.

Warranty Condition

Warranty claims must be submitted in writing and include proof of purchase and details of the defect.

The warranty does not cover:

- Normal wear and tear, misuse, or damage caused by improper maintenance.
- Damage resulting from severe weather conditions, acts of nature, or accidents.
- Modifications, repairs, or installations performed by unauthorized parties.

Repairs or replacements under warranty are at the sole discretion of Sam Outdoor Living.

This policy is effective from 02 Jul 2024.
